4/8/2025 - HOA Board Meeting - Shed Initiative Recap

The HOA Board met on 4.8.2025 for the regularly scheduled meeting, with the main focus being the Shed Initiative that was brought forth by members of the community.  The current community bylaws do not allow for sheds/accessory buildings to be built/placed on any homeowners lot or common area.  With petitions brought forward by the community members, the Board held this meeting to address how to make this change occur.  Following you will find a recap of the meeting, and the process to attain getting sheds into the bylaws for the community.

How To Ensure Success

  • Understand what municipal requirements exist.

​

  • Form an Ad Hoc Committee to assist (providing feedback, educating the membership and gathering votes). It is recommended that committees of this type be chaired by a member of the Board so the Association’s insurance extends to committee members.

  • Establish the criteria for sheds in advance to align the memberships expectations to protect property values (prior to pursuing an official vote).

Requirements

  • Superior Township – Accessory Building Requirements

    • Setbacks – 5ft from side and/or back – Unless corner lot

    • No taller than 15ft

    • 200sq ft- No Building permit – *unless using plumbing or electrical

    • Need to apply for Zoning Approval on all sheds/accessory buildings

    • Not more than twenty-five percent (25%) of the area of the minimum required rear yard may be occupied by accessory structures.

  • HOA Requirements (EXAMPLE)

    • Modification Request with all information included

    • Sheds shall consist of framed construction and be situated on a concrete slab with a rat wall in accordance with all applicable building codes. Prefabricated or aluminum or vinyl sheds are specifically prohibited.

    • Only 1 (one) shed is permitted per home and may not exceed 200 total sq ft in size or 15ft in height

    • The siding, trim, hardware and roof for the shed must match the home.

    • Sheds must be standalone and may not be connected to the residence. 

    • All sheds are restricted entirely to the rear of the home and may not extend past the rear or side setbacks. Sheds shall also meet all Township ordinance and set back requirements - 5ft away from the house, 5ft from the side and 5ft from the rear property lines.

    • **Except on corner lots- must be the rear set back opposite building front entrance to principal building, and shall be set back behind the front building line for the second road frontage**

    • Sheds shall have year-round green trees or landscaping that limit their visibility from the rear and two sides of the shed.

    • Sheds may only be used for the storage of equipment or supplies that are related to the upkeep of the residence. No items are permitted to be stored or collected in front of, next to or behind the shed.

    • Obtain approval from the Association, all necessary permits or approvals must be obtained from the Township prior to constructing a shed

    • Sheds may not be installed on any other homeowner's lot or on any general common element of the Association.

    • If a non-compliant or non-approved shed is constructed, the Association reserves the right to remove such structure at the co-owner’s expense

Timeline

  • Assemble list of all community members that have volunteered to be on the committee. Target 4/18/2025

  • Committee assembled (must be a manageable number) and schedule 1st meeting. Meeting target day by 4/30/2025

  • Committee creates a recommended requirements list to present to Board/In Rhodes.  Discuss recommended requirements and review based on:

    • Construction requirements

    • Township requirements

    • Community uniformity (style/color/roofing/etc.)

    • Landscaping

    • Other items

  • To be a bylaw, these need to be requirements need to be specific, manageable and enforceable.

  • All of this will need to be assembled and prepared for legal review no later than 5/23/2025.

  • Present package to In Rhodes/legal for review and package creation.  

        6/15/2025 target date.​

  • Package presented to the community approximately 90 days prior to the annual meeting.

  • Annual meeting - voting.​​​
